GOVERNING LAW AND JURISDICTION

All matters relating to the Websites and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule (whether of the State of California or any other jurisdiction).

Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Websites shall be instituted exclusively in the federal courts of the United States or the courts of the State of California and County of Los Angeles although CNM retains the right to bring any suit, action, or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

At CNM’s sole discretion, it may require you to submit any disputes arising from the use of these Terms of Use or the Websites, including disputes arising from or concerning the interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying California law.

Any cause of action or claim you may have arising out of or relating to these terms of use or our website must be commenced within one (1 ) year after the cause of action accrues, otherwise, such cause of action or claim will be barred.

WAIVER AND SEVERABILITY

No waiver by CNM of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of CNM to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

Return Policy

Our policy lasts 30 days. If 30 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

Several types of goods are exempt from being returned. Perishable goods such as food, flowers, newspapers or magazines cannot be returned. We also do not accept products that are intimate or sanitary goods, hazardous materials, or flammable liquids or gases.

Only regular priced items may be refunded, unfortunately sale items cannot be refunded.

Exchanges (if applicable)

Gifts

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he will find out about your return.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

Cancellation and Refund Policies are as follows:

EVENT REGISTRATION– IN-PERSON & HYBRID VIRTUAL

  1. Registrations cancelled 3 days before a class or event will be returned in full as account credit to be used for a future class or event at the same value of the original registration.
  2. Refund requests made in lieu of account credit will incur the following fees:
    1. 75% refund for cancellations made 8 days prior to event.
    2. 50% refund for cancellations made 3-7 days prior to event.

  1. Registrations cancelled 24 hours before a class or event may be returned in full as an account credit or a refund.
  2. Registrations cancelled within 24 hours of a class or event and “no-shows” are ineligible for a refund or account credit.

EVENT REGISTRATION – ALL

  1. Registrant substitutions may be made at any time.
  2. CNM reserves the right to cancel or change a class or event, including but not limited to, lack of participation and/or classroom, equipment, or trainer availability. Notification will be provided within 7 days of the class or event, whenever possible. Registrants will have the option of a full refund if rescheduling is not possible.
  3. CNM is not liable for any direct, indirect, consequential, or special damages that may be incurred due to a cancellation of a scheduled class or event, including, but not limited to, cancellation penalties for transportation or accommodations. The customer sole remedy shall be the refund of prepaid course fees.
  4. CNM shall not be liable for damages of any kind resulting from errors or omissions in the class or event training materials, nor shall CNM be liable for any damages resulting from the use of the training materials or other information conveyed at an CNM class or event.

PRODUCTS, PUBLICATIONS & MEMBERSHIPS

  1. Downloadable, electronically transmitted products (PDF file format or otherwise electronic media) are ineligible for a refund or a credit.
  2. CNM will only replace items if they are defective or damaged.  Requests for replacement may be sent to [email protected]; items approved for exchange should be sent to 1000 N. Alameda Street, Suite 250, Los Angeles, CA 90012.
  3. Membership fees are non-refundable.

ALL PURCHASES

  1. Refund, credit, or exchange requests that exceed 30 days after original purchase may not be refunded to due credit limitations.
  2. CNM reserves the right to approve or deny requests under extenuating circumstances.
  3. A purchase of any aforementioned service or product constitutes agreement with these terms.

Maura is known for her expertise in organizational development and strategy and in all aspects of organizational development with a focus on strategic planning, assessment, and evaluation. At CNM, she oversees the client services team and provides consulting, training, and coaching services to a broad range of organizations. Much of her consulting and capacity-building work has been with community-based organizations and public health departments related to effective organizational operations, evaluation practices, and the use of logic models and other assessment tools to support planning, evaluation, and management. A BoardSource Trainer, a certified Advanced Associate, and a Trainer for the Connective Leadership Institute; Maura has completed certification as an executive coach under the International Coaching Federation. She holds a Ph.D. in Organizational Behavior from the Claremont Graduate School, an MBA from the Peter Drucker Graduate Management Center, a BS in Psychology from Georgetown University, and serves as an adjunct professor at USC’s School of Social Work and Department of Psychology.
